Selfie Paint Kits LLC — Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of the Selfie Paint Kits website, products, services, and paint party experiences operated by Selfie Paint Kits LLC ("Selfie Paint Kits," "we," "our," or "us").

By accessing our website, placing an order, reserving a paint party seat, attending an event, or otherwise using our services, you agree to be bound by these Terms. Continued use of our website constitutes acceptance of any future updates or modifications.

Products & Services

Selfie Paint Kits LLC offers both:

  • Custom Paint Kits, created from customer-submitted photos.

  • Ready-to-Paint (Pre-Made) Paint Kits, featuring exclusive paint-by-number artwork.

  • Paint Party Experiences, where customers reserve seats to attend scheduled events.

Certain products and services are subject to additional policies regarding artwork approval, cancellations, returns, refunds, and production.

Orders & Payment

All orders and reservations are subject to acceptance and availability.

We reserve the right to refuse, cancel, limit, or modify any order at our discretion, including orders containing pricing errors, suspected fraud, or violations of these Terms.

All prices are listed in U.S. Dollars (USD) and may change without prior notice.

Custom Artwork & Approval Process

Each Custom Paint Kit is created specifically from the image submitted by the customer.

Before production begins, customers will receive an artwork approval email allowing them to review their design and request revisions.

Customers may request as many revisions as necessary before approving their artwork.

If we do not receive approval within 48 hours after the approval email is sent, the artwork will be automatically approved and production will continue to prevent unnecessary delays.

Customers are responsible for monitoring the email address used during checkout and ensuring they are able to receive communications from Selfie Paint Kits.

Our order confirmation emails include information to help customers receive future communications; however, Selfie Paint Kits LLC is not responsible for emails filtered into spam, junk, promotions, or similar folders.

Once artwork has been approved, either manually or automatically, the order becomes final.

Order Holds & Customer Response Requirements

In certain situations we may be unable to continue processing an order until we receive additional information from the customer.

Examples include, but are not limited to:

  • Uploading an image that does not meet our image requirements

  • Failing to upload an image

  • Requesting an image change after an order has been placed

  • Requesting a product upgrade or modification

  • Responding to artwork, production, or fulfillment issues requiring customer input

  • Any other circumstance requiring us to place an order on hold while awaiting a customer response

When an order is placed on hold, we will attempt to contact the customer using the email address provided with the order.

It is the customer's responsibility to monitor and respond to communications regarding their order.

If we do not receive the required response, updated image, approval, confirmation, or requested information within thirty (30) days of our most recent communication, Selfie Paint Kits LLC reserves the right to cancel the order and close the project.

Orders canceled after thirty (30) days due to no customer response are not eligible for a refund if custom artwork, design work, administrative work, production preparation, or other processing has already been performed.

By placing an order, you acknowledge that substantial custom work may occur before final artwork approval and that such work has value even if the order cannot ultimately be completed due to a lack of customer response.

We may retain portions of your artwork, order information, and project files after cancellation. If you place another order in the future, we may be able to resume work from a previous stage; however, we do not guarantee retention or recovery of prior project data.

Paint Party Reservations

Reservations may be canceled for a full refund up to 48 hours before the scheduled event.

Reservations canceled less than 48 hours before the event are not eligible for a refund.

Instead, customers may choose one of the following (subject to availability):

  • Transfer their reservation to a future paint party.

  • Have the selected paint kit shipped directly to them (shipping charges may apply unless otherwise offered).

Paint kits associated with missed reservations are not eligible for refunds after the 48-hour cancellation window has passed.

Local pickup is not available.

Ready-to-Paint (Pre-Made) Paint Kit Returns

Ready-to-Paint (pre-made) Paint Kits may be returned within 7 days of delivery provided:

  • The kit is unused.

  • The canvas has not been painted.

  • Paints, brushes, and accessories remain unopened.

  • All original contents are included.

Customers are responsible for return shipping unless the return is due to our error or the item arrived damaged or defective.

Refunds are issued after inspection of the returned merchandise.

This return policy applies only to Ready-to-Paint (Pre-Made) Paint Kits and does not apply to any Custom Paint Kits.

Custom Paint Kit Refund & Cancellation Policy

Because every Custom Paint Kit is individually created from customer-submitted images, all custom orders become non-refundable once artwork has been approved, either manually by the customer or automatically after 48 hours.

Refunds will not be issued after approval for reasons including but not limited to:

  • Dissatisfaction with the artwork

  • Dissatisfaction with painting results

  • Delays caused by late approval

  • Change of mind

Orders may only be canceled before artwork approval.

Orders remaining on hold due to lack of customer response may be canceled by Selfie Paint Kits LLC under the Order Holds section of these Terms.

Replacement Policy

If you are dissatisfied with the outcome of your completed painting, we may offer one replacement kit using the same approved artwork.

Replacement kits are offered at our discretion.

Refunds are not available for dissatisfaction with completed painting results.

Delivery Delays

If artwork approval is not received within 24 hours of the approval email being sent, Selfie Paint Kits LLC is not responsible for delays resulting from the customer's delayed approval.

Estimated delivery dates are based on timely customer responses and normal production conditions.

Damaged, Defective, or Incorrect Orders

If your order arrives damaged, defective, incomplete, or incorrect, please contact us within 7 days of delivery.

Please include:

  • Your order number

  • A description of the issue

  • Photos of the damage when applicable

When eligible, we may:

  • Replace damaged or missing items

  • Ship replacement products

  • Assist with carrier claims

  • Provide another appropriate resolution

Event Changes & Cancellations

If Selfie Paint Kits LLC cancels or reschedules a paint party event, customers may choose to:

  • Transfer their reservation to another event, if available.

  • Receive a full refund.

  • Accept another alternative offered by Selfie Paint Kits LLC.

Product Use Disclaimer

Our paint kits and paint party experiences are intended for recreational and entertainment purposes.

Painting results vary based on individual effort, skill level, and painting technique.

We do not guarantee any particular artistic outcome.

User Content & Image Rights

By uploading photographs or other content, you represent that:

  • You own the content or have permission to use it.

  • The content does not violate any third-party rights.

  • The content complies with applicable laws.

You retain ownership of your submitted content.

You grant Selfie Paint Kits LLC a limited, worldwide, royalty-free license to use, reproduce, modify, print, and display submitted content solely for:

  • Creating your paint kit

  • Fulfilling your order

  • Production purposes

  • Quality improvements

  • Marketing and promotional purposes unless otherwise prohibited by law

You acknowledge that uploaded images may be edited or modified to meet production and print requirements.

No compensation will be provided for such use.

We reserve the right to reject content that violates these Terms or that we determine to be inappropriate.

Photography, Video Recording & Promotional Use

Paint party events may be photographed, livestreamed, or recorded.

By attending an event, you grant Selfie Paint Kits LLC permission to use your:

  • Name

  • Image

  • Voice

  • Likeness

  • Artwork

  • Completed paintings

  • Testimonials

  • Photographs

  • Video recordings

for marketing, advertising, educational, promotional, social media, website, print, and future business purposes.

You acknowledge that:

  • No compensation will be provided.

  • No royalties will be owed.

  • No additional approval is required before publication.

Customers wishing to opt out should notify us in writing before attending an event. While we will make reasonable efforts to accommodate requests, we cannot guarantee exclusion from all group photography or video.

Intellectual Property

All website content, branding, product designs, artwork, graphics, templates, packaging, videos, logos, systems, software, and other intellectual property remain the exclusive property of Selfie Paint Kits LLC.

No content may be copied, reproduced, distributed, modified, reverse engineered, sold, republished, or otherwise used without prior written permission.

Company Rights

We reserve the right to:

  • Update products and services

  • Modify pricing

  • Change production methods

  • Revise policies

  • Change event schedules

  • Limit service availability

  • Update website content

at any time without prior notice.

Shipping & Carrier Responsibility

Once an order has been shipped, Selfie Paint Kits LLC is not responsible for delays, damage, or loss caused by third-party shipping carriers.

We will make reasonable efforts to assist customers with carrier claims and shipping-related issues when possible.

SMS/MMS Marketing Program

By opting into our SMS/MMS program, you consent to receive recurring promotional and transactional text messages.

Message and data rates may apply.

Limitation of Liability

To the fullest extent permitted by law, Selfie Paint Kits LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of our website, products, services, or paint party experiences.

Dispute Resolution

Any dispute arising from the use of our website, products, services, or events shall be resolved through binding arbitration in Oklahoma City, Oklahoma, under the Commercial Arbitration Rules of the American Arbitration Association.

Class actions, consolidated proceedings, and representative claims are expressly waived.

Each party shall bear its own legal fees unless otherwise determined by the arbitrator.

Governing Law

These Terms shall be governed by the laws of the State of Oklahoma without regard to conflict of law principles.
